Affiliate Terms and Conditions
These Affiliate Terms and Conditions (" Agreement") govern the participation of affiliates ("Affiliates") in the Apex Fitness Education Affiliate Program ("Program") offered by Apex Fitness Education ("Company").
By signing up for the Program and promoting the Online Diploma in Personal Training ("Product"), Affiliates agree to comply with the terms and conditions outlined below.
1. Enrolment and Participation
1.1 Eligibility: Affiliates must be at least 18 years old to participate in the Program.
1.2 Registration: Affiliates must complete the registration form provided by the Company accurately and truthfully. The Company reserves the right to reject any application at its discretion.
1.3 Program Access: Upon acceptance into the Program, Affiliates will be provided with login credentials to access the Affiliate Dashboard, referral links, and other promotional materials.
2. Commission Structure
2.1 Commission Earnings: Affiliates will earn a commission of £500 for every student they refer to the Online Diploma in Personal Training, provided that the referral uses the Affiliate's unique referral link to complete the sign-up and payment process.
2.2 Commission Payout: Commissions will be paid out on the 1st of each month via a BACS transfer, directly into the Affiliate's designated bank account. Minimum payout thresholds may apply, as determined by the Company.
2.3 Qualified Referrals: Commission will only be paid for referrals who have fully completed the sign-up and payment process for the Product. Incomplete or fraudulent referrals will not be eligible for commission.
3. Promotion and Marketing
3.1 Use of Referral Link: Affiliates must ensure that all referrals are generated using their unique referral link provided by the Company. Sales completed without the use of the referral link will not qualify for commission.
3.2 Prohibited Activities: Affiliates are prohibited from engaging in any misleading, fraudulent, or unethical marketing practices when promoting the Product. This includes but is not limited to spamming, using misleading advertising claims, or engaging in illegal activities.
3.3 Compliance with Laws and Regulations: Affiliates must comply with all applicable laws, regulations, and industry standards while promoting the Product. This includes compliance with data protection and privacy laws.
4. Termination
4.1 Termination by Company: The Company reserves the right to terminate an Affiliate's participation in the Program at any time, with or without cause, at its sole discretion. In such cases, any outstanding commissions will be forfeited.
4.2 Termination by Affiliate: Affiliates may terminate their participation in the Program by providing written notice to the Company. Any outstanding commissions will be paid out according to the regular commission payout schedule.
5. Modifications
The Company reserves the right to modify, suspend, or terminate the Program, including these Terms and Conditions, at any time without prior notice. Affiliates will be notified of any significant changes via email or through the Affiliate Dashboard.
6. Limitation of Liability
The Company shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the Program or the Affiliate's participation in it.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, Scotland and Northern Ireland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, Scotland and Northern Ireland.
By participating in the Program, Affiliates acknowledge that they have read, understood, and agree to abide by these Terms and Conditions.
